Civil Procedure Question
To invoke a court’s jurisdiction to hear and determine proceedings instituted by Writ of Summons, the plaintiff must ensure valid service of the originating process.
By reference to the Rules of the Supreme Court 1971, any other legislative instruments and any relevant authorities, explain what steps a plaintiff must take and why, to serve: i. A defendant who resides in a place outside WA; and ii. A defendant who resides within WA but who, despite numerous attempts at personal service, is proving illusive; and iii. A corporate defendant.
