Question on Standard of duty. It will be important in a number of contexts in this course to decide if the contractual obligation is strict or one to use reasonable care. Revise the issue of how to determine the standard of the contractual obligation. Carter Contract Law in Australia [29-13]–[29-17] is very useful on this point. Recall the case of Greaves & Co (Contractors) Ltd v Baynham Meikle & Partners [1975] 1 WLR 1095, (Contracts casebook para 29.36) which you studied in Contracts (it was the case where the engineers did not properly design the floor of the factory). How would the reasoning differ if the plaintiff’s claim were put in negligence rather than breach of contract? Do you think the result would have been different?
