Where a group of employees instructed by a registered organisation (union) to undertake unprotected industrial action have then suffered economic loss because of this instruction, what are their rights and remedies under the FWA 2009? The instruction to strike was given due to the employer breaching terms in an enterprise agreement. Is there action available against the union? Is there action available against the employer?
