Question: you are considering buying a property but to be safe...

Question details

You are considering buying a property. But to be safe, you want your lawyer to check the title and rates. You request for a clause stating “contract subject to buyer’s solicitor approval within 7 days”. Your lawyer calls you up the next day and says that there is a planning and building restriction on the title and you will not be able to build your dream home. Your lawyer writes to the seller advising this. The seller is demanding you purchase. What principle is applicable here?
